Life Made Delicious* “Movies for a Year” Contest
Official Contest Rules (the “Rules”)
No Purchase Necessary. Making a purchase will not increase chances of winning.
1. CONTEST DESCRIPTION AND HOW TO ENTER
The Life Made Delicious* “Movies for a Year” Contest (the “Contest”) is sponsored by General Mills Canada Corporation (the “Sponsor”).
The Contest starts Sunday October 1st, 2017 at 12:00 am (EDT) and ends Wednesday January 31st, 2018 at 11:59 pm (EDT) (the “Contest Period”). The Sponsor’s computer is the official time keeping device for the Contest. Entries must be received during the Contest Period.
To enter the Contest, visit at www.lifemadedelicious.ca/cineplexcontest (the “Contest Website”). To enter the Contest, follow the entry instructions on the Contest Website and complete the form. In order to enter the Contest, entrants will first be required to either (a) enter their General Mills Life Made Delicious membership information or (b) sign up to become a member of General Mills Life Made Delicious. Entrants who are not yet members of Life Made Delicious and are interested in signing up for membership shall be prompted to become a member and fill in their registration information through the Contest Website.
Limit of one (1) entry per person for the entire length of the Contest Period.
2. ELIGIBILITY
The Contest is open to all residents of British Columbia, Alberta, Manitoba, Saskatchewan, Ontario, Quebec, Newfoundland, Nova Scotia, New Brunswick, and Prince Edward Island (the “Contest Provinces”) who have reached the age of majority in their province of residence.
The Contest is not open to: (i) employees, officers, directors, representatives or agents of the Sponsor or any of their respective parent companies, subsidiaries and affiliates; (ii) the spouse and any member of the immediate family (defined as biological, step or adoptive mother, father, daughter, son, sister or brother) of any person described in (i); and (iii) any person who resides with any person described in (i) or (ii). Potential prize winners will have to state in the Declaration and Release such information as their address, occupation and name of their employer to confirm they are not a person excluded from eligibility to enter.
Your entry into this Contest constitutes full and unconditional agreement to these Rules. The Sponsor’s decisions are final and binding in all matters related to the Contest.
3. PRIZE
There will be ten (10) prizes (each, a “Prize”) awarded, each consisting of 104 individual Cineplex® “Admit One” movie passes (individually, a “Pass”; more than one, “Passes”). The approximate retail value of each Prize is $1400.00 CDN. Each Pass entitles the bearer to a general admission to a movie at any Cineplex Entertainment theatre in Canada and is subject to the conditions below.
Each Pass ticket is valid until June 30, 2019 as indicated by stamp on the back of the Pass. No time extension on expired tickets. No substitutions. Passes are non-replaceable and non-refundable. Passes are not valid for non-feature film performances. Passes cannot be combined with any other promotion, coupon, voucher or special discount offer. Passes may be applied towards the admission to an IMAX®, UltraAVX®, UltraAVX®3D, VIP room admission, digital 3D presentation, D-Box seating and reserved seating performances, subject to payment of additional fees as applicable. Passes are not for re-sale and have no cash value. Not valid for earning SCENETM points. Additional restrictions may apply. Any and all additional costs and expenses associated with the acceptance and use of the Prize, including but not limited to the purchase of concession items, are the sole responsibility of the winner.
The Prize must be accepted by the winner as described in these Rules and cannot be transferred to another person, substituted for another prize, or exchanged in whole or in part, for cash. The winner may transfer Passes to another person however.
Sponsor is not responsible for changes made by Cineplex to the Pass restrictions described above after the Contest start date.
4. SELECTION OF POTENTIAL PRIZE WINNER AND PRIZE CLAIM
a. Potential Prize Winner
On Thursday, February 1st, 2018 at 10:00 am (EST) a random draw will be conducted at the Sponsor’s premises from the total valid entries received during the Contest Period. Odds of winning will depend on the number of valid entries received during the Contest Period. After the first winner has been randomly selected, their name will be removed from the valid entries and the next winner will be randomly selected. This will repeat until all ten (10) winners have been selected.
The Prize shall be awarded to the first ten (10) selected entrants whose name was randomly selected from all valid entries, provided such entrants meets the eligibility requirements and fulfills all obligations as set out in these Official Contest Rules.
b. Prize Claim Process
The selected entrants will be notified by e-mail or telephone that he/she has been selected to receive the Prize. Before being declared a Prize winner, the selected entrants will be required to correctly answer a time-limited, mathematical skill-testing question, without assistance of any kind whether mechanical or otherwise, to be administered at a mutually convenient time by telephone. The selected entrants will also be required to sign and return, within the time stipulated in the documents, a declaration of compliance with these Rules and a liability and publicity release (the “Declaration and Release”).
If the selected entrant cannot be reached within ten (10) business days of the date of being declared a potential winner, fails to submit the completed Declaration and Release, or fails to correctly answer the skill-testing question within the time allotted, the Sponsor shall conclude that the selected entrant has forfeited the Prize and it will randomly draw another entry from among the valid entries.
The Prize will be delivered to the qualified winner at the address provided by him/her in his/her entry form.
5. CONDITIONS OF ENTRY
All entries become the property of the Sponsor and will not be returned.
Any use of automated devices or system is prohibited and will result in disqualification. Entries attempted by methods other than those described in these Rules shall be deemed void. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different e-mail addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified at the sole discretion of the Sponsor.
In the event of a dispute as to the identity or eligibility of the winner for online entries, the authorized account holder of the e-mail address used to enter the contest will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. A selected entrant may be required to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.
Sponsor also reserves the right at its sole discretion to disqualify from this Contest, and any future contest or other promotion Sponsor conducts, any individual that it finds or believes to be tampering with the entry process, or the operation of the Contest, Contest Website or Cineplex Website, to be acting in violation of these Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
6. CONSENT TO COLLECTION, USE AND DISCLOSURE OF PERSONAL INFORMATION
By entering the Contest and voluntarily providing their personal information, each entrant consents and agrees to the collection, use and disclosure of the entrant’s personal information by Sponsor and its third party services’ providers for the purpose of administering the Contest and fulfilling the Contest obligations, including—but not limited to—contacting the entrant with respect to the Contest if entrant is selected to win the Prize. The Sponsor will not use an entrant’s personal information for any other reason without consent. Nor will the Sponsor otherwise disclose personal information to any third party without consent.
7. LIABILITY
The Sponsor shall not be held responsible for any accident, negligence, printing, administrative or other errors that may arise or occur in connection with the Contest.
The Sponsor reserves the right at its sole discretion to modify, amend or terminate this Contest in whole or in part, at any time without notice and with no obligation or liability.
If the Contest is terminated, in whole or in part, before the end of the Contest Period, the Sponsor may, at its sole discretion, select the winner in a random drawing from all eligible, non-suspect entries recorded by the Sponsor
The Sponsor is not responsible for: (i) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions or disconnections in the Contest Website, Cineplex Website, phone lines or network hardware or software; (iii) unauthorized human intervention in any part of the entry process or the Contest; (iv) technical or human error, which may occur in the administration of the Contest or the processing of entries; or (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest, or receipt or use or misuse of the Prize.
If for any reason an entrant's entry is confirmed to have been deleted in error by Sponsor, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest.
Entries are subject to verification and will be declared invalid if they are incomplete, garbled, forged, falsified, altered or tampered with in any way.
8. RELEASE
By entering the Contest, entrants agree that the Sponsor and any Prize provider shall not be responsible or liable for any losses or injuries of any kind resulting from participating in the Contest or acceptance, possession and/or use or misuse of the Prize, and agree to release, discharge and hold harmless the Sponsor and its respective officers, directors, parent companies, subsidiaries, affiliates, related companies, advertising and promotional agencies, third party service providers, the Contest’s administrator and Prize suppliers (collectively, the “Releasees”) from all claims or damages arising out of entrant’s participation in the Contest and/or acceptance, use or misuse of any prize.
By accepting the Prize, the Prize winner agrees to the use of his/her name, city of residence, voice, photograph and/or other likeness in any related publicity for Sponsor, in any medium, including presence on the Sponsor’s website, without further compensation or permission, worldwide and in perpetuity. Sponsor makes no representation or warranty that any identification, videotape, photograph and/or likeness of the winner will be broadcast or used otherwise in any manner.
9. DISPUTE – QUEBEC RESIDENTS
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
10. OTHER
The invalidity or unenforceability of any provision of these Official Contest Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
The Contest is subject to all applicable laws and shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
